General terms and conditions
The following general terms and conditions apply to all nautical experiences and activities contracted with La Romana Marbella or, where applicable, with the service provider responsible for delivering the activity.
Minors
All minors must be accompanied by a responsible adult who assumes supervision throughout the entire activity.
Persons with reduced mobility or medical conditions
Persons with reduced mobility, pregnant women, or clients with any relevant medical condition must inform us at least 48 hours prior to the nautical activity. This will allow us to assess safety conditions and adapt the experience where possible.
Personal responsibility
Each participant is responsible for their own actions, behaviour and personal belongings during the activity. The company accepts no responsibility for damage caused by negligence, improper use of the facilities, or failure to comply with the instructions of the captain or crew.
Bookings made through hotels, brokers or other channels
If the booking is made through a hotel, tourist apartment, agency, broker or any other intermediary, such channel shall bear no responsibility for the operation. Responsibility will rest exclusively with La Romana Marbella or, where applicable, with the nautical service provider directly delivering the service.
Punctuality and delays
Clients must arrive at the agreed meeting point at the indicated time and with sufficient margin to board the vessel.
If an activity is contracted, for example, for 4 hours, it will take place during the agreed 4-hour period, ending exactly at the scheduled time.
Late arrival by the client will not result in any extension or compensation for lost time.
Exceptionally and subject to operational availability, the crew may offer a few courtesy minutes, but this is not guaranteed.
Alcohol consumption, substances and behaviour rules
Excessive alcohol consumption and the use of any substances prohibited by law are strictly forbidden.
The captain has full authority to:

limit alcohol consumption if it is considered a safety risk;

authorise or prohibit smoking. If permitted, smoking will only be allowed at the stern, ensuring that ashes, cigarette butts or smoke do not affect the crew or other passengers.
Any behaviour that compromises safety or onboard coexistence may result in the early termination of the activity without any right to a refund.
Personal equipment
Each passenger must bring whatever they consider necessary to enjoy the activity, including:

towel, swimwear, sunscreen, hat, sunglasses, personal medication and any other items for regular use.
Passengers are advised to be in good physical condition and to inform us in advance of any limitations.
Weather conditions and safety
Safety always takes precedence over any other consideration.
In the event of adverse weather or sea conditions, the captain or the company may modify the route, delay the departure or propose a rescheduling.
The captain has the right to cancel the nautical activity if deemed necessary due to sea conditions, safety reasons or failure by passengers to comply with onboard rules.
In cases of cancellation due to non-compliance with rules or inappropriate behaviour, no refund will be issued.
In cases of cancellation due exclusively to weather or safety reasons, the applicable cancellation policy will apply, prioritising a solution favourable to the client.
Personal belongings
The company accepts no responsibility for loss, damage or theft of personal belongings during the activity (including phones, cameras, clothing, bags, etc.). Clients are advised to keep such items protected and away from water.
Captain’s authority
The captain is the highest authority on board, and their decisions are final and binding. All instructions must be strictly followed to ensure the safety of all passengers.
Recordings, photos and image use
Clients may take photos or videos provided they do not interfere with navigation or disturb other passengers.
In some cases, the company may take photos or videos for promotional purposes, with prior notice to clients who may be clearly identifiable.
Cancellation policy
In the event of cancellation due to force majeure or with at least 30 days’ notice, the amount paid will be refunded, applying a 10% administrative fee.
If the cancellation is made with less than 30 days’ notice, we reserve the right to retain 20% of the amount paid as a non-refundable deposit.
If the departure has to be cancelled due to mechanical or maintenance reasons, an alternative vessel of similar characteristics, or even newer or larger, will be offered, subject to availability.
If on the scheduled date adverse weather or sea conditions prevent safe navigation —always at the captain’s discretion and considering, among other factors, winds of 20 knots or more and/or waves exceeding 1 metre— we will attempt to reschedule the activity to another available date. If this is not possible, a full refund of the amount paid will be issued.
